Complaint to the administrative court (WSA) about the voivode's inaction or delay

Updated: 1 November 2026

You can file a complaint to the voivodeship administrative court (WSA) about the voivode's inaction or delay at any time after filing a ponaglenie (Art. 53 § 2b of the Law on proceedings before administrative courts) — there is no final deadline and no need to wait for a reply. You file it at the voivodeship office, which has 30 days to forward it to the court. Court fee: 100 zł.

Inaction or delay?

Choose one in the complaint. A ponaglenie covering both grounds opens the way to either complaint.

Frequently asked questions

When can I complain to the WSA about the voivode's inaction?

At any time after filing a ponaglenie (Art. 53 § 2b) — there is no final deadline and no need to wait for a reply to the ponaglenie.

How much does a complaint to the WSA cost?

The court fee is 100 zł; if you win, the court orders it refunded. You can apply for legal aid (PPF form).

Where do I file the complaint?

At the voivodeship office handling the case; it has 30 days to forward the complaint with the files to the competent WSA.

Who can represent me before the WSA?

An advocate, a legal adviser, or your spouse, parents, siblings or children (Art. 35). Not an intermediary company or your employer. You may sign the complaint yourself.

The court may award up to 44,517.80 zł — usually only for a flagrant breach of the law.
